Herling David Romero Adrianza is an experienced commercial, construction, employment, and real estate litigator. Herling has experience litigating highly complicated construction and commercial matters involving delay claims, real estate disputes, contract interpretation, jobsite-defect cases, and insurance coverage disputes. Herling wields this experience when representing businesses and individuals to achieve their desired results whether through trial, alternative dispute resolution, or through direct negotiations. Herling has represented clients in the construction, manufacturing, architecture and design, real estate development, and insurance fields.

On employment matters, Herling advises defendants and plaintiffs on matters related to wage and hour, allegations of discrimination and harassment, accommodations, and other disputes between employees and employers. As a counselor, Herling advises clients in daily business operations stemming from the employer-employee relationship such as employment contracts, policies and handbooks, independent contractor relationships, severance agreements, restrictive covenants, noncompete agreements and offer letters. With objectivity at the core of his approach, Herling is known for presenting facts and explaining legal obligations in a straight-forward, easily consumable way, helping clients make decisions that proactively avoid conflicts whenever possible. Should conflicts be unavoidable, Herling defends clients thoroughly and effectively. Herling’s inherent entrepreneurial spirit, ‘can do’ attitude and technical skills are the hallmark of his practice.

Herling’s passion for advocacy and providing access to justice is directly connected to his personal journey to becoming a lawyer. Following his graduation from Boston College, Herling worked as a middle school math teacher in a deeply underserved community through the Teach for America program. It was advocating for access to appropriate schooling that sparked his desire to become a lawyer. After witnessing the community’s inability to be heard, Herling chose his path as a lawyer so that he may establish an equal playing field for his clients where both sides are heard and considered in a fair resolution process.

Prior to joining Kenney & Sams, Herling was an associate with a small law firm in Massachusetts handling a range of employment and intellectual property law matters. His work includes resolving disputes, negotiating settlements, conducting depositions, and supporting trials involving both businesses and individual clients. His practical experience also includes patent litigation as well as criminal law. Additionally, while in law school Herling gained foundational business experience serving as the Chief Operating Officer for Northeastern University School of Law’s innovative IP Clinic.
